Terms of Service

1. Acceptance of Terms
By accessing or using MyInboxer ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. The Service is operated by MyInboxer, based in Québec, Canada ("we", "us", "our").
2. Eligibility
You must be at least 14 years old (the age of majority in Québec for consent to online services) to use the Service. By agreeing to these Terms, you represent and warrant that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. Description of the Service
MyInboxer is an AI‑powered email management tool that helps you identify and recover legitimate business emails that have been misdirected to your spam folder. The Service connects to your email account via OAuth 2.0 and:
- Scans metadata (and, for classification purposes, may temporarily process content) of emails in your spam folder.
- Uses machine learning models (including third‑party models from Mistral, OpenAI, and Gemini) to evaluate whether an email is likely legitimate.
- With your action or predefined rules, moves such emails to your inbox or another folder.
The Service is provided on a monthly subscription basis and is offered "as is" and "as available", as detailed in Section 12.
4. User Accounts and Responsibilities
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and promptly notify us of any unauthorized use.
- Not share your account or credentials with others.
- Be responsible for all activities that occur under your account.
We reserve the right to suspend or terminate your account if any information provided is inaccurate or if you violate these Terms.
5. Fees, Subscriptions, and Payments
Subscription Plans: The Service is offered on a monthly subscription basis. Fees are clearly displayed on our website and are in US dollars (USD). All fees are exclusive of applicable taxes, which you are responsible for paying.
Billing and Automatic Renewal: By subscribing, you authorize us (through our payment processor, Stripe) to charge your provided payment method on a recurring monthly basis. Your subscription will automatically renew each month until you cancel.
Cancellation and Refunds: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period; you will not be charged for subsequent months. Fees are non‑refundable except as required by applicable law. We do not provide prorated refunds for partial months of service.
Price Changes: We may change our subscription fees with 30 days' notice. If you do not agree to the price change, you may cancel before the change takes effect.
Payment Disputes: If you believe a charge was made in error, please contact us at hello@myinboxer.com. Unresolved disputes may be subject to the dispute resolution process in Section 14.
6. Email Access and Permissions
By connecting your email account, you grant us permission to access your spam folder using the OAuth 2.0 protocol. You understand and agree that:
- We will only access the spam folder (or other folders you explicitly authorize).
- We will read email metadata (sender, subject, date, etc.) and may temporarily process email content for classification; we do not permanently store the content.
- We may move emails between folders based on your actions or automated rules you set.
- We may store anonymized classification data to improve our AI models.
You may revoke our access at any time through your email provider's settings or by disconnecting your account from within MyInboxer. Upon revocation, we will cease accessing your email and delete any associated metadata, subject to our data retention policy.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to our systems or interfere with the proper functioning of the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service to send spam, phishing messages, or otherwise harass others.
- Use automated means (scripts, bots, etc.) to access the Service without our express written permission.
- Upload or transmit any viruses, malware, or other harmful code.
Violation of this section may result in immediate termination of your account and legal action.
8. Intellectual Property Rights
The Service, including its software, algorithms, user interface, and content (excluding your data), is owned by MyInboxer and is protected by intellectual property laws. We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service in accordance with these Terms. You retain all rights to your data, and you grant us a license to process it solely to provide the Service to you.
9. Third‑Party Services and Links
The Service may integrate with third‑party email providers or contain links to external websites. We are not responsible for the content, privacy practices, or terms of those third parties. Your interactions with them are solely between you and the third party.
10. Termination
You may terminate your account at any time by contacting us or using the account deletion feature. We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms or fail to pay subscription fees. Upon termination, your right to use the Service will cease, and we will delete your data in accordance with our Privacy Policy, unless we are required to retain it for legal reasons.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR‑FREE, SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION OBTAINED FROM US SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
YOU ACKNOWLEDGE THAT THE SERVICE MAY NOT CORRECTLY IDENTIFY EVERY LEGITIMATE EMAIL OR MAY MISCLASSIFY EMAILS. WE ARE NOT RESPONSIBLE FOR ANY MISSED OR INCORRECTLY CLASSIFIED EMAILS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYINBOXER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DURING THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to defend, indemnify, and hold harmless MyInboxer and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third‑party rights.
14. Governing Law and Dispute Resolution
Governing Law: These Terms shall be governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to its conflict of laws principles.
Informal Resolution: Before filing a claim, you agree to attempt to resolve any dispute informally by contacting us at hello@myinboxer.com. We will attempt to resolve the dispute within 30 days. If the dispute is not resolved, you or we may proceed as set forth below.
Mediation: If the dispute cannot be resolved informally, we both agree to first attempt mediation through a recognized mediation service in Montréal, QC, with costs shared equally, before resorting to court action.
Jurisdiction: Any legal action arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of the Province of Québec sitting in Montréal, QC. You consent to the personal jurisdiction of those courts.
Class Action Waiver: Any proceedings to resolve disputes will be conducted on an individual basis. You agree not to bring a class action against us.
15. Changes to Terms
We may modify these Terms at any time by posting the revised version on this page and updating the "Last updated" date. If we make material changes, we will notify you via email or through the Service. Your continued use of the Service after the effective date constitutes acceptance of the new Terms.
16. General Provisions
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision. These Terms constitute the entire agreement between you and us regarding the Service.
